In the sources of Islamic jurisprudence and civil law of Iran, the general rule is that sale of endowed property is prohibited. In other words, not every legal act that causes the endowed property transfer to the others is permitted. However, in some circumstances, for preserving of endowed organization or for benefits of beneficiary's persons in endowment, the sale of endowed property is necessary. In the Islamic law and civil law of Iran, in exceptional cases, sale of endowed property is permitted, including where the endowed property is destroyed or there is a serious dispute between the beneficiaries of endowment. In this research, the permitted cases for sale of endowed property is discussed.
