In Islam it has been anticipated for rapidly and justly resolving actions and beyond concentration of judge of arbitration that considered as a kind of personalizing judgment. Thus litigants can select the one qualified beyond governmental judicial system and tried to resolve the animosity in this way.
Most Shiite jurisprudents have accepted judge of arbitration but most of them have refuted this assumption in the absence era. Because according to them all jurisprudents in this era are appointed for judgment, and there is no qualified judge but not - appointed as an arbitration .In this article different doctrines are proposed to solve the problem and judge's legitimacy of arbitration in the absence era within
people's rights has been proved. So it would be accepted personalizing the justice in the manner of judge of arbitration from Shiite perspective.
