According to this rule, anyone who receives another person’s property in any capacity would be liable to return this property or compensate the owner if the property has been lost or destroyed unintentionally; and if it is damaged to rectify the damage. This is a general rule and could include any possible benefit derived from the property. In this paper, we have tried to argue and analyze this rule and examine whether it should be extended to include lost benefits too. This elaboration could have important practical implications and could solve some practical problems}, keywords = {authority to possess,Benefit,Liability,possession,Tort,unused benefits,used}, title_fa = {قاعده علی الید و ضمان منافع}, abstract_fa = {قاعده علی الید، مستند به حدیث نبوی است که بین همه فقیهان فرق مسلمان مورد بحث و بررسی قرار گرفته است. بر پایه این قاعده، گیرنده مال غیر، ضامن رد عین یا بدل آن در صورت تلف و جبران خسارت در صورت نقصان آن است. این قاعده با اطلاق خود، همان طور که می‌تواند دلیلی بر ضمان عین باشد، می‌تواند مبین ضمان منفعت و عمل نیز باشد. در این نوشتار سعی شده است با بررسی استدلالی و تحلیلی قاعدة مذکور و بر پایه عموم و اطلاق ادله مورد استناد، علاوه بر ضمان متصرف نسبت به عین، ضمان وی نسبت به منافع آن نیز اثبات شود که در این صورت می‌‌توان از بسیاری مسائل و مباحث مورد ابتلا گره‌گشایی کرد.}, keywords_fa = {ضمان,مثل – قیمت – ید,منافع غیر مستوفات,منافع مستوفات}, url = {https://jmb.ut.ac.ir/article_18180.html}, eprint = {https://jmb.ut.ac.ir/article_18180_190b7a12ac236396916688dcf27852ee.pdf} }
